LIMITED WARRANTY
 
Nood warrants for a period of five (5) years from the date of shipment that our flooring products are free of defects in material or manufacture.
 
To be eligible for replacement under any of these warranties the consumer must notify Nood at PO Box 2746, Dalton, GA 30722-2746 within ninety (90) days after claim defect is discovered. Nood reserves the right to inspect the installation of its product to be claimed defective. Any defective material will be replaced at no charge if the defect is found prior to installation. If a defect is found after installation Nood will inspect the material and determine if the claim is valid. If the product is determined to be defective, subject to the limitations in the warranty, the product will be replaced. Nood assumes no liability for labor costs in the installation of the products claimed defective.
 
EXCLUSIONS TO WARRANTY

1. Installation of visibly defective material.
2. Installation of material with adhesives other than those that are recommended. Application of finishes or cleaners other than those that are recommended.
3. Problems caused by moisture, hydrostatic pressure, or alkali in the substrate.
4. Damage to flooring material from high heels or spikes or inadequate furniture rest, glides or casters.
5. Improper or inadequate installation or maintenance.
6. Exterior installations.
7. Sale of "seconds", "off goods" or any other irregular (non-first quality) flooring materials. With respect to these such are sold "as is" and seller makes no warranties whatsoever, express or implied with respect thereto, including warranties of merchantability or fitness for a particular purpose.
8. Shade/color variations after installation.
9. Fading resulting from heavy sunlight penetration.
10. Any implied promise made by any salesman or representative.
11. Skive/knife marks on product is an inherent characteristic of recycled rubber and is not considered a defect.

This warranty is in lieu of any other warranty expressed or implied. Nood shall not be liable for any incidental or consequential damages which may result from a defect. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific rights and you also may have rights which may vary from state to state.
